El Senado y C\u00e1mara de Diputados de la Naci\u00f3n Argentina reunidos en Congreso, etc. sancionan con fuerza de Ley:<\/p>\n
ART\u00cdCULO 1. Sustit\u00fayense los art\u00edculos 5\u00b0 y 84 de la Ley 11.723, modificada por el decreto ley 12.063\/67, por los siguientes:<\/p>\n
Art\u00edculo 5\u00b0: La propiedad intelectual sobre sus obras corresponde a los autores durante su vida y a sus herederos o derechohabientes hasta setenta a\u00f1os contados a partir del 1\u00b0 de enero del a\u00f1o siguiente al de la muerte del autor.<\/p>\n
En los caso de obras en colaboraci\u00f3n, este t\u00e9rmino comenzar\u00e1 a contarse desde el 1\u00b0 de enero del a\u00f1o siguiente al de la muerte del \u00faltimo colaborador. Para las obras p\u00f3stumas, el t\u00e9rmino de setenta a\u00f1os empezar\u00e1 a correr a partir del 1\u00b0 de enero del a\u00f1os siguiente al de la muerte del autor.<\/p>\n
En el caso de que un autor falleciera sin dejar herederos, y se declarase vacante su herencia, los derechos que a aqu\u00e9l correspondiesen sobre sus obras pasar\u00e1n al Estado por todo el t\u00e9rmino de ley, sin perjuicio de los derechos de terceros.<\/p>\n
Art\u00edculo 84: Las obras que se encontraren bajo el dominio p\u00fablico, sin que hubiesen transcurrido los t\u00e9rminos de protecci\u00f3n previstos en esta ley, volver\u00e1n autom\u00e1ticamente al dominio privado, sin perjuicio de los derechos que hubieran adquirido terceros sobre las reproducciones de esas obras hechas durante el lapso en que las mismas estuvieron bajo el dominio p\u00fablico.<\/p>\n
ART\u00cdCULO 2. Comun\u00edquese al Poder Ejecutivo.<\/p>\n
